Don’t hide behind COVID-19; elect PM immediately- Former NPP Aspirant

Former NPP Parliamentary Aspirant for Sunyani West Constituency in the Bono region, Mr. Theophilus Asoma Kyeremeh, has called on the Municipal Chief Executive not to hide behind the COVID-19 pandemic but ensure a Presiding Member is elected immediately.

In a statement signed and copied to Dinpa FM, Mr. Asoma said, the Assembly has failed to elect a Presiding member since the Assembly members were sworn into office in January this year and this has greatly affected the work of the Assembly.

    
“The political structure of the assembly is hierarchical.  It works through the executive committee and its subsidiary committees of development planning, social services, works, finance and administration and justice and Security. All these committees are virtually inactive at the assembly”, the statement said.

“As it stands now the Municipal Chief Executive, Hon. Marten Obeng is solely responsible for the running of the Assembly which shouldn’t be so because the assembly has structures”, he lamented.

I wish to express my discomfort, displeasure and disappointment over what i would described as “unqualified” manner in which my Assembly (Sunyani West Municipal Assembly) is being administered currently in the absence of Presiding Member.

First of all the inability for the Assembly led by the MCE to organize election to elect a presiding member who will chair assembly meetings is greatly affecting the activities of the Assembly.

 As it stands now the Municipal Chief Executive, Hon. Marten Obeng is solely responsible for the running of the Assembly which shouldn’t be so because the assembly has structures.

The structure of the system defines roles and responsibilities of the various structures and the line of communication.

At the national level the ministry deals with policy formulation leaving implementation and coordination to the lower levels. The coordination function is carried out at the regional levels by the Regional coordinating council (RCC). However, the policy implementation is carried out by the District Assembly through its sub-structures and committees.

The unit committee is the basic unit of the district assembly structure. The relationship between the Assembly and the sub-district structures is defined in the local government instruments (LI) 1967 which established them. The councils and the units committees constitute important structures through which various committees have opportunities to relate to the assemblies.  

The assembly must share its powers, functions and resources with the councils and the unit committee. The relationship between the assembly and the councils and unit committee must be functionally supportive and complementary.

The political structure of the assembly is hierarchical.  It works through the executive committee and its subsidiary committees of development planning, social services, works, finance and administration and justice and Security. All these committees are virtually inactive at the assembly.

There is also the public relation and complains committee (PRCC) that falls directly under the office of the presiding member. The head of the general assembly is the Presiding Member (PM) and the head of the executive committee is the MCE.

Currently, the MCE takes decision solely and solely implements them, in absence of Presiding Member it’s the MCE who benefits that why to me he does not see the need to organize election for the assembly members to elect their Presiding Member for the Assembly.

The actions of the MCE presupposes that he has been constantly relegating the calls to elect the PM  expressed by members of the assembly after seeking the misleading views of the coordinating Director.

Article 244 of the 1992 Constitution states: “The District Assembly shall have a Presiding Member who shall be elected by the assembly from among its members. “The Presiding Member shall be elected by at least two-thirds majority of all the members of the assembly. The Coordinating Director should not be left out.

Per my checks, the Presiding Member shall preside over the meetings of the assembly and perform such other functions as may be prescribed by law. Section 17 of the Local Government Act 936as amended, restated the constitutional provision and pointed out that the effect of the provision is that “no assembly meeting can be convened and conducted in the absence of a substantive Presiding Member.

In my considered view, the MCE is engaging himself in an unconstitutional and an illegal venture by circumventing the constitutional requirement of two-thirds of all the members of an assembly to elect a Presiding Member in stipulated period when the Assembly failed to elect PM at their first election.

I would want to know, where was the budget the MCE is using in managing the Assembly, COVID-19 etc approved. The Assembly has Assembly members both elected and appointees so why can’t we have our PM.

I pray that we shouldn’t hide behind COVID-19 because Tarkwa Nsuaem Municipal Assembly this may elected new MCE
